Residential Tenancies - new changes

A probationary period of six months will apply to all residential tenancies and the landlord will be allowed to terminate a tenancy during this period without reason.  The tenant will enjoy security of tenure for the following three and a half years and an entitlement to a further four years security of tenure.  If the landlord refuses consent to assignment or subletting, the tenant may terminate the letting on notice to the landlord.  It is not possible to negotiate out o these provisions.  The Act sets out a number of grounds on which a landlord may terminate a tenancy.

Landlord?s are required to register tenancies with the Private Residential Tenancies Board.  The costs of registration is €70 per dwelling with a maximum of ?300 for a number of dwellings in the same building registered at the same time.  The fees will double for late registrations.

The Act is a complex piece of legislation and contains many changes to residential tenancies law.  Expert advice should be obtained.
